% 19.12.2017 By these petitions, petitioners have prayed for quashing of cross FIRs, details whereof are as under
FIR No. 2576/2015 under Sections 323/506/392/34 IPC registered at police station Shakarpur on the complaint of Yogesh Kumar Sharma (respondent no. 2 in Cr1. M.C. 5058/2017. Yogesh Kumar Sharma is also petitioner no.1 (accused) in Cr1. M.C. 2824/20 17; and FIR No. 2577/2015 under Sections 323/354/509/34 IPC registered at police station Shakarpur on the complaint of Neeta Sharma (respondent no. 2 in Cr1. 2824/2017). Smt. Neeta Sharma is also petitioner no.1 (accused) in Cr1. M.C. 5058/20 17.
Other petitioners/private respondents, namely, Deepak Arora, Shivam Gupta and Ali Mushtaq were also present at the time of the incident, at the Service Centre of MIs Nokia India Pvt. Ltd., where quarrel took place. A perusal of the aforesaid FIRs indicates that quarrel took place between the petitioners and private respondents in both the petitions, on some trivial issue, which led to the registration of aforesaid cross FIRs. It is submitted that petitioners/accused persons and complainants have now settled their disputes amicably. The complainants in the FIR namely, Neeta Sharma, Yogesh and Ali Mushtaq are present in Court and have been identified by SI Shri Gopal of police station Shakarpur. The complainants submit that they have settled the matter with the petitioner of their own free ill and without any undue force, pressure or coercion, therefore, they have no objection in case the FIRs are quashed. Accordingly, in the facts and circumstances of this case as noted above, in the interest of justice, aforesaid FIRs and the consequent proceedings emanating therefrom are quashed, in view of the settlement. Both the petitions are disposed of in the above terms. Dasti.
