After some arguments, the learned counsel for the respondent states that the appointing authority shall consider the notices sent by the petitioner earlier as its request for appointing an Arbitrator in accordance with the arbitration clause and shall take necessary steps for appointment of an Arbitrator within a period of 30 days. He states that names of three Arbitrators shall be sent to the petitioner and the petitioner would be at liberty to choose one out of three to be appointed as an Arbitrator. Needless to state that in view of the Arbitration and Conciliation (Amendment) Act, 2015 the Arbitrator appointment shall comply with Section 12(1)(b) read with Schedule V of the Act and shall not be a person who is ineligible by virtue Section 12(5) of the Act read with schedule VII of the Act. 2.
In view of the aforesaid statement, the petitioner seeks to withdraw the present petition.
