Petitioner impugns order dated 30.07.2016 whereby leave to defend application of the petitioner has been dismissed and an eviction order passed.

Respondent had filed the subject eviction seeking eviction of the petitioner on the ground of bonafide necessity under Section 14(1) (e) of the Delhi Rent Control Act, 1958, from one room with covered Verandah, kitchen, common bathroom and latrine on the ground floor of property No, 7290, Gali No. 2, Prem Nagar, Delhi (with common area as shown in yellow colour), more particularly as shown in red colour in the site plan annexed with the eviction petition. 3.

Learned counsel for the parties submit that the parties have settled their disputes and petitioner has already handed over peaceful vacant possession of the tenanted premises to the respondent. RC.REV. 91/2017

Learned counsels for the parties further submit that all claims and disputes between the parties have been fully and finally settled and now there are no dues against each other. 5.

Learned counsel for the petitioner seeks leave to withdraw the petition.
