% 31.05.2017 This application has brought to light very disturbing facts. The first informant Moshami, who is wife of the petitioner has been brought along by the counsel to vouchsafe that he has been falsely implicated. It is noted that in the FIR No. 75/2017 registered on her statement on 74.2017 she had made clear allegations about the petitioner, her husband, having fired at her injuring her in the process. The affidavit which has been submitted with the application of the first informant was sworn on 15.5.2017, it being attested by a notary public, noticeably upon she being identified by Mr. Sumit Kumar, Advocate, the counsel representing the petitioner herein. It is clear the counsel for the petitioner has been in touch and contact with the first informant, apparently having a bearing on her version even while the matter is under investigation.
Given the above facts, the role of the advocate and also of the first informant will also have to be properly investigated in that apparently undue BAIL APPLN. 1054/2017
influence may have been exercised at some or other stage. Given the serious allegations made in the case, it is not proper at this stage of the investigation to admit the petitioner on bail particularly against the backdrop of the fact that earlier bail application, it being Bail Application No. 864/2017, was withdrawn on 9th May, 2017. Dismissed.
