% 07.11.2016 Petitioner is aggrieved by the order passed by the ATMCD dated 29.8.2016. These proceedings had arisen between the parties i.e. Naresh Trehan and North Delhi Municipal Corporation. The petitioner before this Court is Ram Kumar. He was not a party to those proceedings. He had moved an application under Order 1 Rule 10 of the CPC before the ATMCD on 16.01.2016. This application was dismissed; however, the applicant/petitioner was permitted to file documents and to orally argue the matter at the time of final arguments.
Contention of the petitioner before this Court is that although he has been permitted to file documents and address arguments but none of these arguments have been appreciated by the ATMCD in the correct perspective.
This Court is of the view that this petition is not maintainable as the petitioner who is aggrieved by an order passed by the ATMCD has an alternate remedy before the District Judge. This petition is disposed of with liberty granted to the petitioner to challenge the aforenoted order before the appropriate Forum. INDERMEET KAUR, J NOVEMBER 07, 2016 ndn
