O R D E R

% 15.09.2017 This is an application under Section 438 Cr.P.C filed on behalf of the petitioner for grant of anticipatory bail in case FIR No.255/2017, under Sections 308/323/506/509/34 IPC, registered at Police Station Keshav Puram, Delhi.

Learned senior counsel appearing for the petitioner has submitted that the allegations as alleged in the FIR are false and baseless. He further submits that the injured has already been discharged from the hospital on the same day and nothing is to be recovered from the possession of the present petitioner. Learned senior counsel has further submitted that the petitioner too has lodged a counter FIR bearing No.268/2017, under Sections 354B/323/509/506/34 IPC at the same Police Station and further submits that the petitioner has already joined the investigation and he is further ready to join the investigation as and when required and prays that the petitioner

may be released on anticipatory bail.

Learned APP for the State has vehemently opposed the bail application. However, on instructions from the IO, he has submitted that the petitioner has joined the investigation.

Looking into the above facts and circumstances, the petitioner is directed to join further investigation as and when directed and in the event of his arrest, the petitioner be released on anticipatory bail, on his furnishing bail bond in the sum of Rs.20,000/- with one surety of the like amount to the satisfaction of the IO/SHO concerned, with the condition that he shall not extend any threat to the injured/complainant; he shall not leave the country without prior permission of the concerned Court below and he shall not tamper with the prosecution evidence.

The present bail application is allowed and stands disposed of accordingly.
