WP(C) 9141/2016 & CM No. 36991/2016 The learned counsel for the petitioner submits that: (i) the petitioner's case be considered on compassionate ground by the respondent corporation because he is a heart patient undergoing treatment at the Mohan Heart Care Cardiology Clinic; (ii) his new place of posting is about 45 kms away from his residence which would require him to travel four to five hours daily; (iii) the petitioner seeks to be posted in a place near his residence; (iv) the petitioner could be examined by any of the approved doctors of the respondent corporation to ascertain his medical condition; and (v) in terms of clause 26 of the Posting Policy of the respondent corporation there is scope for compassionate posting of employees of the corporation.

In the circumstances, at the request of the learned counsel for the petitioner, the respondent corporation is directed to treat this writ petition as a representation. The representation shall be decided by respondent no.2, who shall accord a hearing to the petitioner on 06.10.2016 at 3.00 p.m. and thereafter pass a reasoned order.

The petition stands disposed off in the above terms. It is made clear, the Court has expressed no opinion on the merits of the case.
