This suit for partition and rendition of accounts is pending since 30th May, 2017 and plaintiff till now, in spite of repeated opportunities, has not served the defendants.

Though the plaint was accompanied with an application for interim relief, but no ex parte relief was also granted to the plaintiff. 3.

The counsel for the plaintiff withdraws the suit with liberty to file again, stating that the compromise talks are underway between the parties. 4.

The suit is dismissed as withdrawn with liberty to the plaintiff to, if the settlement is not arrived at, sue afresh, subject to applicable laws. No costs.
