% 13.10.2017 IA No.11867/2017 This application is under Order 23 Rule 1 CPC for withdrawl of this suit on the terms and conditions per Exhibit P-2 and also per affidavits of the applicant no.2 and 3. It is submitted that the matter has been amicably settled between the parties and the undertakings are given by defendant no. 2 and 3. It is also agreed that the defendant no.2 and 3 they shall not violate any of the terms and conditions of the said settlement. The defendant no.2 and 3 have also paid a demand draft of Rs.4,00,000/- to the applicant as per the undertaking annexure P-2. On the instructions of the plaintiff the learned counsel for the applicant/plaintiff prays for withdraw of this suit. The suit stands dismissed as withdrawn.

The dates given stands cancelled.
