% 10.09.2018 CM APPL 36798/2018 (early hearing) This is a joint application for early hearing of the matter filed on the ground that the parties have arrived at an amicable settlement before the Delhi High Court Mediation and Conciliation Centre. At the outset, it is pointed out that there is an inadvertent error in para (i) of the settlement agreement dated 20.08.2018, wherein, it has been agreed that the parties will seek divorce by filing a petition under Section 13B(1) of Hindu Marriage Act whereas it should read as 'they would seek divorce under Special Marriage Act'. Copy of settlement agreement has been placed on record setting out the terms of settlement arrived at between the parties. Copy of settlement agreement has been signed by the parties and their respective counsels. It has been agreed that the parties will seek a divorce by filing a petition under Special Marriage Act. All other conditions mentioned in the settlement agreement dated 20.08.2018 shall remain the same and parties shall remain bound by the terms and conditions of the settlement agreement dated 20.08.2018

and they shall faithfully comply with the same. With aforesaid modification, the application stands disposed of. MAT.APP.(F.C.) 111/2017 In view of the settlement agreement dated 20.08.2018, the appeal stands disposed of. The Court appreciates the efforts put in by the counsels for the parties and the parties for early resolution in the matter. The date fixed for 13.09.2018 is cancelled.
