% 24.01.2017 CO.APPL. 167/2017 The present application has been instituted on behalf of the petitioner seeking leave to withdraw the accompanying company petition in terms of an out-of-court settlement arrived at by and between the parties, to the satisfaction of the petitioner.

Learned counsel appearing on behalf of the applicant/petitioner states that in terms of the aforesaid out-of-settlement the petitioner has received a sum of Rs.12,56,624/- through RTGS on 12.01.2017 as full and final settlement between the parties.

In view of the foregoing the present application is allowed. The petitioner is granted leave to withdraw the accompanying company petition. The application is disposed of accordingly.

CO.PET. 968/2016 In view of the above, the present company petition is dismissed as withdrawn and disposed of accordingly. Pending applications, if any, stand disposed of.
