% 28.11.2017 Mr Dhawan, learned counsel appearing on behalf of the appellant, after some arguments, states that he would not press this appeal, if the respondent were to secure his interest, in the event the objections under Section 34 of Arbitration and Conciliation Act, 1996, instituted by them, assailing the impugned Award dated 16.12.2016, were to succeed. Mr Suhail Dutt, learned Senior Counsel, appearing on behalf of the respondent, states that, in the event, the objections filed by the appellant herein, are upheld and the impugned Award is set aside, they would secure the appellant, if so directed by the learned Single Judge, whilst disposing off the said objections under Section 34 of the Arbitration and Conciliation Act, 1996.

Directed accordingly.

Needless to state that we have not expressed any opinion on the relative merits of the contentions as urged by counsel for the parties in the present appeal.

The appeal along with the pending applications are dismissed as not pressed, and disposed off accordingly.
