versus STATE (NCT OF DELHI) & ANR ..... Respondents Through Mr. G.M. Farooqui, APP with SI Ramesh Kumar, P.S. Sultan Puri for the State Respondent no. 2 in person.

CORAM:

HON'BLE MR. JUSTICE A.K. PATHAK

O R D E R

% 31.07.2017 FIR No. 38/2014 under Section 363 IPC was registered at Police Station Sultan Puri against the petitioner on the complaint of respondent no. 2, that is, father of the prosecutrix. It is submitted that prosecutrix was aged about 17 1⁄2 years at the time of incident. Now she is 21 years of age. It is submitted that petitioner and prosecutrix fell in love with each other and got married on 20th May, 2015 at Arya Samaj Mandir Trust. Certificate of marriage has been placed on record.

Prosecutrix is also present in Court along with her father, that is, respondent no. 2. Respondent no. 2 and prosecutrix submit that they are not willing to pursue the FIR any further as

prosecutrix and petitioner are living together right from the date of their marriage.

This fact has been verified by SI Ramesh Kumar, P.S. Sultan Puri.

Keeping in mind the above facts, no fruitful purpose would be served to keep the criminal proceedings pending. Accordingly, in the interest of justice, FIR No. 38/2014 under Section 363 IPC registered at Police Station Sultan Puri, which is at the investigation stage, is quashed. Petition is disposed of in the above terms. Miscellaneous applications are disposed of as infructuous. Dasti.
