O R D E R

% 21.10.2016 Marital discord between the petitioner no.1 and respondent no.2 had led to registration of present FIR against the petitioners. Petitioner nos. 2 and 3 are relatives of petitioner no.1.

Petitioner no.1 and respondent no. 2 have settled their disputes amicably vide Compromise-cum-Settlement Deed dated 16th November, 2015. Terms of settlement are stated to have been complied with. Marriage between the petitioner no.1 and respondent no.2 has also been dissolved vide decree of divorce by mutual consent dated 11th August, 2016 passed by the Family Court (West District), Tis Hazari Court, Delhi. Respondent no.2 is present in Court and submits that she has received the entire settled amount. She further states that she has no objection in case the FIR is quashed.

Keeping in mind that husband (petitioner no.1) and wife (respondent no. 2) have decided to part ways and, in fact, obtained decree of divorce, no fruitful purpose would be served in keeping them entangled in present criminal proceedings. Accordingly, in the interest of justice, FIR 1353/2015 under Sections 498-A/406/34 registered at police station Hari Nagar and the consequent proceedings emanating therefrom are quashed. Writ petition is disposed of in the above terms. Miscellaneous application is disposed of as infructuous.
