W.P.(C) No. 4978/2017 After some arguments, learned senior counsel for the petitioner, on instructions, states that since the Government of India has passed an order dated 09.06.2017 in the disciplinary proceedings and by resort to Rule 9 of the CCS (Pension) Rules, 1972 has imposed a penalty of withholding of 100% of the monthly pension otherwise

admissible to the petitioner, on a permanent basis and the entire gratuity of the petitioner has also been permanently withheld, the petitioner shall assail the order dated 09.06.2017 on all available grounds in independent proceedings before the Tribunal. In view of the aforesaid, the petition is dismissed as withdrawn with the liberty aforesaid.
