% 21.01.2019 Crl. M.A. 1371/2019 (Recording of Compromise) By the present petition under Section 482 Cr.P.C., petitioner has, inter alia, prayed for quashing of complaint case no. 630438/2016 titled M/s Gabriel India Ltd. vs. Arvind Walia pending in the court of learned Metropolitan Magistrate, South East District, Saket Court, New Delhi. Petitioner has also assailed the summoning order dated 13.07.2018. During the pendency of this petition, petitioner and respondent no.2 have settled their disputes amicably.
By this application, petitioner and respondent have jointly prayed that aforementioned complaint case may be quashed in view of the compromise
having been arrived at between them. Deed of Compromise and Settlement dated 21.12.2018 has been annexed with this application as Annexure 'A'. Petitioner as well as Mr. Anshul Bhargava, Authorised Representative of respondent are present in Court.
Both of them admit having settled the matter amicably vide Annexure 'A'. Mr. Anshul Bhargava submits that respondent has no objection in case the aforementioned complaint case is quashed in view of the compromise.
Accordingly, application is allowed and aforementioned complaint case is quashed in view of the settlement. Petition is disposed of.
Miscellaneous applications are disposed of as infructuous.
