Learned counsel for the petitioner states that the petitioner has since passed away which fact is also verified by learned Additional Standing Counsel for the State on instructions.

Learned Additional Standing Counsel for State has handed over a status report which is taken on record. As per the status report FSL report has been received, which goes in favour of the petitioner. He states that based on the FSL report received and also the fact that the petitioner has died, final report will be filed before the Court within two weeks. 3.

Learned Counsel for the petitioner submits that in view of the fact that no offence has been found against the petitioner original documents are required to be returned to the legal heirs of the petitioner. W.P.(CRL) 1708/2017

On conclusion of investigation, in case it is found that no case is made out which in any case stands abated qua the petitioner because of his death, original documents, so seized from the possession of the petitioner, if not incriminating qua any other accused, will be returned to the legal heirs of the petitioner.

Petition is disposed of.
