O R D E R

% 27.10.2017 After arguing for some time, counsel for the respondent fairly submits that a sole Arbitrator be appointed in terms of clause-20 of the Partnership deed dated 1st April, 1996 executed between the parties. He further submits that such appointment should be without prejudice to his rights and contentions including the contention with respect to the claims being barred by law of limitation. Counsel for the petitioner has no objection to the same.

In view of the statements made above, I direct the parties to appear before the Delhi International Arbitration Centre (DIAC) on 20th November, 2017.

DIAC will appoint a retired Additional District Judge as a sole Arbitrator to adjudicate the disputes between the parties in accordance with the Rules of DIAC.
