The petitioner, as indicated by the evidence collected thus far, has been associating with her brother Imtiaz @ Kabir in running agency, the name and style whereof has been changed several times with the office being also shifted over the period, offering placement services to job seekers against consideration collected. The services offered were not secured and the persons who paid the money had been cheated, a large number of them approaching the police during the investigation of the case at hand.

The brother of the petitioner was arrested on 13.05.2017 and continues to be in custody. During the pendency of the application for anticipatory bail before the court of sessions, some interim BAIL APPLN. 1078/2017 protection was granted but the record of investigation reveals that the petitioner was not very cooperative as she refused to share the

documents or material the investigating agency was searching for. It may be that she has settled the dispute with some of the persons cheated by paying them off.

But, as submitted by the learned additional public prosecutor, the investigation qua 7-8 other similarly placed victims requires to be carried out.

In the facts and circumstances brought out, it cannot be said that the allegations against the petitioner are unfounded. Therefore, no case for anticipatory bail is made out.

Dismissed.
