O R D E R

% 31.07.2017 C.M. No. 26998/2017 (Direction on behalf of the respondent) By this application, the respondent seeks directions of this court to the effect that the appellant be directed to vacate the premises and hand over the possession thereof immediately. To appreciate this contention, this court has gone through the order dated 31.05.2017, which has been passed on the consent of the parties. Clause (a) of the order dated 31.05.2017 says that the appellant undertakes to vacate the suit premises in question and shall handover the vacant and peaceful possession thereof to the respondent on or before 30.09.2017.

Apparently, the order dated 31.05.2017 itself records that the appellant has to vacate the premises by 30.09.2017, therefore there

cannot be any question to direct the appellant to vacate the suit premises immediately contrary to the order passed by this court. This court does not find any substance in the application, therefore the same is dismissed.

However, it is made clear that the parties shall not be debarred to take their legal remedies in case of violation of any directions passed in the order dated 31.05.2017.
