% 30.05.2017 Termination of lease contract in respect of R-1 compartment having CC of 309 tonne in train No.12265 Ex.DEE to JAT vide order of 1st May, 2017 is the subject matter of this petition. Upon notice, Mr. Jagjit Singh, learned Standing Counsel for respondents, informs that impugned order of 1st May, 2017 is sub-judice in an appeal filed by petitioner.
In view of aforesaid, this petition and applications are disposed of with direction to Commercial Manager (Freight) of Northern Railways, Baroda House, New Delhi to pass a speaking order within four weeks on petitioner's pending appeal by treating it to be a representation and its fate be made known to petitioner within two weeks thereafter to enable W.P.(C) 4959/2017
petitioner to have recourse to law, if need be. To facilitate an early disposal of pending appeal/ representation, let learned Standing Counsel for respondents intimate the date of hearing to petitioner's counsel within a week.
Purely as an interim measure, till the fate of petitioner's representation is made known to it, status quo as of today qua the licensing of compartment in question be maintained. With aforesaid directions, this petition and applications are disposed of.
A copy of this order be given dasti under the signatures of Court Master to counsel for parties.
