% 28.01.2019 Quashing of FIR No.423/2009, under Sections 324/307/ 34 IPC read with Sections 25, 27 and 54 of Arms Act, registered at Police Station Najagrah, Delhi, is sought on the basis of Memorandum of Understanding of 17th February, 2017.

Learned Additional Public Prosecutor for respondent-State submits that the matter is now pending before the Trial Court for final arguments. Since trial in this case is at the fag end, therefore, I am not inclined to entertain this petition on merits or even on the basis of settlement, as the offence committed by petitioners is heinous. This petition and the application are accordingly dismissed while not commenting on the merits of the case.
