versus STATE (NCT OF DELHI) ..... Respondent Through:
Mr. Akshai Malik, APP for the State.
CORAM:
HON'BLE MR. JUSTICE R.K.GAUBA
O R D E R
% 07.09.2018 The applicant, a South African, is facing trial in Sessions case (440321/2016) arising out of FIR No. 1669/2015 of police station Bindapur on the charge for offences under Sections 302/201/34 of Indian Penal Code, 1860 (IPC). Besides her, her husband is an accused in addition to certain others.
The case concerns homicidal death of one Pooja, the autopsy showing external injuries being the cause of her death. Though the first informant, Meetu Nanda @ Alisa is stated to have expired, there is other incriminating evidence available to prime facie show complicity of the applicant, this including CCTV footage showing use of a vehicle registered in her name by her husband to carry away the dead body for it to be dumped so as to destroy evidence. There is evidence showing her presence at the spot at the relevant point of time.
BAIL APPLN. 2089/2018
In these circumstances, the denial of bail midway the trial by the Additional Sessions Judge by order dated 18.07.2018 cannot be faulted. No good grounds are made out for release of the applicant on bail. The petition and the application filed therewith are dismissed. R.K.GAUBA, J SEPTEMBER 07, 2018 nk BAIL APPLN. 2089/2018
