% 04.03.2020 CM No.8778/2020 The appellant is seeking restoration of the appeal which was dismissed in default on 10th January, 2020. Since there was no appearance on behalf of respondent No.1 on 20th January, 2020, the notice to respondent No.1 is dispensed with.

Learned counsel for the appellant submits that he has no objection to the restoration of the cross appeal bearing MAC.APP.445/2017 which was also dismissed in default by the common order. The application is allowed and this appeal as well as MAC.APP.445/2017 are restored.

MAC.APP.804/2016 & MAC.APP.445/2017 Issue Court notice to Savita Devi, respondent No.1 in MAC.APP.804/2016 and appellant in MAC.APP.445/2017 as well as her counsel, returnable on 14th July, 2020.

The record of the Claims Tribunal be requisitioned before the next date of hearing.
