CRL.M.C. 2334/2017 & CRL.M.A.9484/2017 This is a petition under Section 482 Cr.P.C. for quashing of FIR No.271/2016, under Sections 420/467/468/469/471 IPC read with Section 120 B IPC, registered at Police Station-Rani Bagh, Delhi and all proceedings emanating therefrom.
Learned counsel for the petitioners submits that during the course of business dealings some misunderstanding took place between the parties,
resulting into registration of the aforesaid FIR. Counsel further submits that after the registration of the FIR, the near relatives and the friends intervened and the matter has been amicably settled between the parties vide settlement deed dated 27.05.2017. He further submits that the parties have acted upon the terms of settlement. He further submits that to have better relationship between the parties in near future, the present FIR, which is coming as a hurdle in their way, may be quashed.
Mr.Rajan Sahni, Director of respondent No.2/complainant, Life Technologies India Pvt. Ltd. is present and submits that he has been authorized by the respondent No.2/complainant to represent on its behalf. Mr.Rajan Sahni has been identified by the Investigating Officer SI Sandeep Kumar, PS-Rani Bagh. Mr.Rajan Sahni submits that the matter has been amicably settled with the petitioners vide settlement deed dated 27.05.2017 and in terms of the settlement, Rs.3.17 crore has already been paid. He further submits that today he has received Rs.19.93 crores by way of demand drafts Nos. 084964 dated 25.05.2017, 084962 dated 25.05.2017 and 084985 dated 26.05.2017, all drawn on Bank of America, Chennai. He further submits that nothing remains to be adjudicated further. He further submits that the settlement/compromise has taken place voluntarily, without any force, pressure or coercion. He submits that he has no objection if the FIR in question is quashed.
Keeping in view the above facts and circumstances, since the matter has been amicably settled between the parties, to promote peace in the life of parties and for maintaining good relationship between the parties, I deem it appropriate to quash the FIR and all its subsequent proceedings.
Consequently, FIR No.271/2016, under Sections 420/467/468/469/471 IPC
read with Section 120 B IPC, registered at Police Station-Rani Bagh, Delhi and all proceedings arising therefrom are hereby quashed. Parties to remain bound by the terms of settlement dated 27.05.2017. The present petition is allowed and disposed of accordingly. All pending application(s) (if any) also stand disposed of.
