O R D E R

The petitioner has filed the present petition impugning an order dated 29.03.2016 rejecting the petitioner's application for renewal of the certificate of practice of Notary, which was valid till 05.09.2015. The said request was rejected on the ground that it was received by the concerned Department after the expiry of the said licence. In terms of the relevant Rules (Rule 8B of the Notary Rules, 1956), the said application was required to be filed at least six months prior to the expiry of the said licence. 2.

The present matter was taken up for hearing on 31.05.2017 and this Court had directed that the petitioner may make an application for being considered as a Notary and the same would be considered in accordance with law. It was further, directed that the due credit would be given to the petitioner for the time spent as a Notary.

The learned counsel appearing for the petitioner has informed this Court that the petitioner has filed an application for being appointed as a Notary and has also been called for interview, which is now scheduled on 17.10.2018.

The learned counsel appearing for the respondent also points out that the petitioner's application would be considered as a fresh issue of licence to act as a Notary.

In view of the above, the learned counsel appearing for the petitioner does not press the present petition at this stage. The petition is, accordingly, dismissed as not pressed.

It is, however, clarified that the order directing the concerned Authority to consider the petitioner's past experience as a Notary would stand and the concerned Authority shall have due regard to the fact that the petitioner has a significant experience as a Notary. Needless to state that if the petitioner is aggrieved by any order passed by the concerned Authority, he is at liberty to apply.

The pending application is also disposed of.
