IN THE HIGH COURT OF DELHI AT NEW DELHI

+ CRL.L.P. 777/2014 STATE ..... Petitioner Through:

Ms. Neelam Sharma, APP for State.

versus RAKESH @ LOTA & ANR ..... Respondents Through:

None.

CORAM:

HON'BLE MR. JUSTICE A.K. PATHAK

O R D E R

% 10.01.2017 A perusal of record shows that no sincere efforts have been made to serve the respondents right from 4th August, 2015 onwards. Vide order dated 4th August, 2015 petitioner was directed to take steps to serve the respondents and notice was made returnable for 11th December, 2015. However, steps were not taken by the petitioner. Vide order dated 11th December, 2015 fresh notice was directed to be issued to the respondents. However, fresh and correct address in terms of the order dated 4th August, 2015 was not filed, therefore, notice could not be issued. Vide order dated 6th April, 2016 petitioner was directed to take steps to serve the respondents. Process fee was filed but the same was under objections. No steps were taken to remove the objections, therefore, notice could not be issued. Again vide order dated 8th August, 2016 petitioner was directed to take steps to serve the respondents.

Process was filed but it was returned under

objections. Again no steps were taken to remove the objections, therefore, notice could not be issued for today. I do not find any justification to grant the petitioner more time to serve the respondents. Petition is dismissed for non-prosecution.
