By this application, petitioner seeks release of the amount of Rs.2,50,000/- which was deposited by the petitioner in terms of the order dated 28.7.2017.

Parties had entered into a settlement and as per the settlement, the petitioner had agreed to pay total sum of Rs.11 lacs to the respondent; Rs.4 lacs was paid at the time of the first motion, further Rs.4 lacs was paid at the time of second motion and balance Rs.3 lacs was to be paid at the time of quashing of the FIR. 3.

Learned counsel for the petitioner points out that by an order dated 18.9.2018 in W.P.

(Crl.) No.1562/2018, subject FIR No.130/2016 has already been quashed and the said order records that CRL.REV.P. 545/2017

balance sum of Rs.3 lacs was paid to respondent No.2 in court at the time of quashing of the subject FIR.

Copy of the said order is produced in court and the same is taken on record. 4.

Since the entire amount, as settled between the parties has already been paid to the respondent, there does not appear to be any impediment in releasing amount of Rs.2,50,000/- in favour of the petitioner.

In view of the above, the application is allowed. Registry is directed to release the amount of Rs.2,50,000/- along with interest accrued thereon in favour of the petitioner.
