1. This is an application under Section 151 CPC filed by the Petitioner seeking revival of the main petition.

2. It is pointed out that in terms of the order dated 3rd July, 2015, the documents were submitted by the Petitioner to Dr. Ramesh Chugh, Medical Superintendent of the Respondent. However, the bills remained unpaid.

3. In that view of the matter, this application is allowed and the main petition is restored to its original file.

4. Learned counsel for the parties are agreeable to the Court appointing an

Arbitrator to adjudicate the disputes between them arising out of the Agreement dated 12th December, 2008.

5. Accordingly, this Court appoints Mr. Rakesh Kapoor, former District Judge, (Telephone No. 23993200) residing 5-C, Court Road, Civil Line, Delhi 110 054 as sole Arbitrator to adjudicate the disputes between the parties including their claims and counter-claims. The arbitration shall take place under the aegis of the Delhi International Arbitration Centre ('DAC'). The fees of the learned Arbitrator will be in terms of the Delhi High Court Arbitration Centre (Arbitrators' Fees) Rules.

6. The petition is disposed of. A copy of this order be communicated to the learned Arbitrator as well as Additional Coordinator, DAC forthwith. S.MURALIDHAR, J DECEMBER 06, 2016 Rm
