versus GOVT OF NCT DELHI ..... Respondent Through Mr. Hirein Sharma, Addl. PP for State with SI Arvind Kumar, PS Hauz Khas.
CORAM:
HON'BLE MR. JUSTICE A. K. CHAWLA
O R D E R
% 31.05.2017 CRL. M.A. 9616/2017 (exemption) Exemption allowed, subject to just exceptions. Application stands disposed off.
BAIL APPLN. 1077/2017 Heard.
There are allegations of cheating to the tune of Rs.95 Lakhs on a forged and fabricated cheque.
Amount, undisputedly, is credited to the account of the applicant's firm and none else. Sh.Sharma, Addl. PP on instructions from the IO, states that with the amount so credited to the account of the applicant, the applicant cleared his loan liability of almost Rs.40 Lacs and got released the mortgaged property, which he had furnished as a security. Investigations are at the initial stages. By the application, the applicant seeks interim bail on the premise that his father is sick.
For the purpose, advertence is made to the purported medical certificate, which records for Sh. Dilip Singh aged about 92 years complaining of chest pain (left side), cough, fever and some ortho issues in the knee joints. The nature of sickness is not such, which requires immediate attention of the applicant. Suffice to say, as per the certificate, father of the applicant was admitted in the hospital on 4.5.2017 and what is the status as of today, cannot be ascertained therefrom.
Dismissed.
