Pursuant to notice issued on 17.08.2023, Mr.

Shubhendu Bhattacharyya, learned counsel enters appearance on behalf of the Official Liquidator and confirms that the judgement debtor - company is in liquidation. He states that the award holder is required to lodge a claim before the Official Liquidator in Form No. 66 of the Companies (Court) Rules, 1959.

As the judgement debtor - company is in liquidation, no other recourse is available to the decree holder. The enforcement proceedings are, therefore, disposed of with liberty to the decree holder to make its claim before the Official Liquidator. The decree holder is also at liberty to seek revival of these proceedings if there is any change in circumstances.
