% 24.09.2018 By this petition, the petitioner seeks parole on the ground that his mother is due for surgery on 27th September, 2018 for knee replacement and to maintain social ties.

A status report has been handed over which is taken on record. As per the status report the mother of the petitioner was advised for surgery on 27th August, 2018 which is being fixed for 27th September, 2018, however, no advance payment etc. have been made. It is thus apparent that the surgery of knee replacement has not been finalised for 27th September, 2018. Moreover knee replacement is an elective surgery and not a medical emergency. W.P.(CRL) 2667/2018

A perusal of the nominal roll reveals that the petitioner has been on parole by this Court for a period of 12 weeks in the year 2018 besides furlough for a period of 3 weeks, thus in the 9 months yet to be concluded of this year the petitioner has availed paroles/furlough for a period of 15 weeks. Considering the paroles and furlough availed by the petitioner and knee surgery being an elective surgery, this Court finds no ground to grant parole to the petitioner.

Petition is dismissed.
