Process fee has not been filed by the appellant in terms of the order dated 12.07.2017 nor has he complied with the directions issued to him to deposit the arrears of maintenance directly into the bank account of the respondent.

On 31.08.2017, when the present appeal was listed before the Joint Registrar, none had appeared for the appellant and it was recorded that process fee has not been filed by the appellant. 3.

Today, learned counsel for the appellant appears and states that the appellant was not in a financial position to deposit the maintenance as ordered and he does not wish to pursue the present appeal. Instead, he seeks unconditional leave to withdraw the same. MAT.APP.(F.C.) 114/2017

Leave, as prayed for, is granted. The appeal is dismissed as withdrawn along with the pending applications. HIMA KOHLI, J.
