After arguments, this appeal is disposed of with the consent order that there will be a money decree in favour of the appellant and against the respondent for a sum of Rs.3 lacs alongwith interest @ 12% per annum simple from 17.9.2006 till the date of payment. 2.

I may note that amount of Rs.3 lacs was received by the respondent/defendant towards the immovable property and property prices in fact in Delhi went up considerably from around the year 2006 to 2011 or so. Therefore interest @ 12% per annum simple is neither more nor less,

and therefore, a money decree is passed in favour of the appellant and against the respondent as stated above.

Amount will be paid by the respondent to the appellant in terms of today's consent order within a period of five months from today, failing which the rate of interest will stand increased to 16% per annum simple.

Parties are however left to bear their own costs. 4.

Appeal is accordingly disposed of in terms of aforesaid observations.
