By this application the plaintiff seeks liberty to withdraw the suit as disputes and differences between the plaintiff and defendants have been settled during the pendency of the suit.

Application is disposed of permitting the plaintiff to withdraw the suit. CS(OS) 282/2017 1.

In view of the fact that I.A. No. 10880/2017 is supported by the affidavit of the plaintiff, suit is dismissed as withdrawn. 2.

Since the suit has been withdrawn before the issues were settled, Court fee is directed to be returned to the plaintiff in terms of Section 16A of the Court Fee Act.
