PoppowThe application is disposed of Cr1. M.C. No.2309/2015 & Cr1. M.C. No.2315/2015 These are two petitions filed by the petitioners under Section 482 Cr.P.C. for quashing of two cross FIR Nos. 120/2015 & 121/2015, both registered on 24th February, 2015, at P.S. Roop Nagar, Delhi. Brief facts of the case are that on 24th February, 2015, an altercation took place between the parties. On the basis of the complaint made by Pawan Kumar Grover (respondent No.2 in Cr1. M.C. No.2309/2015), the .

FIR No.120/2015 was registered under Sections 308/452/34 IPC against Naresh Khosla and Rohit Khosla, (petitioners in the said petition). One of the said petitioners, namely, Mr.Rohit Khosla also made a complaint in respect of the same incident, on the basis of which the FIR No. 121/2015 was registered under Sections 323/452/34 IPC against Pawan Kumar Grover and Nitish (petitioners in Cr1. M.C. No.2315/2015). During the pendency of the proceedings, the parties have settled their disputes amicably. The said settlement was arrived at between them before the Delhi Mediation Centre, Tis Hazari Courts, Delhi on 27th February, 2015. Copy of the mediation report is placed on the record which is duly signed by the parties. The parties shall be bound by the terms and conditions of the settlement.

They are also present in Court and are duly identified by their respective counsel. They have confirmed the said settlement. Considering the facts and circumstances of the case, in order to maintain peace and harmony between the parties and in view of the averments made in the petitions as well as the settlement arrived at between the parties, the FIR Nos. 120/2015 & 121/2015, both registered on 24th February, 2015, at P.S.

(27 are hereby quashed qua the respective petitioners. Since the State machinery has been used, while quashing the FIR, I impose the cost of Rs. 10,000/- each upon all the petitioners in both the above said petitions, which shall be deposited by them with the Delhi High Court Advocates' Welfare Fund within six weeks from today. The original receipts of depositing the cost shall be filed by the petitioners in the Registry within eight weeks and a copy thereof be also handed over to the JO. In case the cost is not deposited by the petitioners within the stipulated period, the matter shall be listed before Court for further directions. The petitions are accordingly disposed of.
