% 21.07.2017 CA No.1204/2017 Heard. Vide order dated 22.09.2016 this Court allowed the scheme of the arrangement under Section 391-394 of the Companies Act, 1956 and petitioner was directed to file the copy of order within 30 days of the receipt of certified copy of order before the ROC. The hard copy of the order was deposited with the ROC within time, however, the petitioner tried to upload the soft copy thereof which could not be done. Now, there is delay of 181 days in uploading the soft copy of order dated 22.09.2016 with ROC. Considering the facts and circumstances, the delay stands condoned. Let the certified copy of the order dated 22.09.2016 be uploaded by way of IMC-28 within 30 days from today. The application stands disposed of.
