% 07.10.2016 Present writ petition has been filed seeking a direction to respondent nos. 1 and 2 to remove the unauthorised staircase leading to First Floor of property bearing no. B-24 (W.H.S) Timber Market, Kirti Nagar, Delhi.

Learned counsel for the petitioner states that despite a number of representations having been submitted to the respondents, the encroachment has not been removed by the respondents till date. Consequently, the present writ petition is disposed of with a direction to respondent no.2-DSIIDC to decide the petitioner's representation dated 29th August, 2016 after giving an opportunity of hearing to both the petitioner as well as respondent no.3.

With the aforesaid directions, present writ petition and the applications are disposed of. This Court, however, clarifies that it has not expressed any opinion on the merits of the controversy. The rights and contentions of all the parties are left open. MANMOHAN, J OCTOBER 07, 2016 KA
