% 11.09.2018 Impugned order of 19th August, 2014 (Annexure P-14) rejects petitioner's application for allotment of alternate plot in lieu of acquired land due to non-submission of requisite documents. It is the case of petitioner that the change of address was intimated to respondent vide Communication of 6th November, 2006, which was duly acknowledged by respondent. It is so evident from the intimation (Annexure P-3) regarding change of address. It is also evident from the Communication of 31st July, 2013 (Annexure P-9) that the Communication was sent by respondent to petitioner at the old address.

Upon hearing, I find that the communication to seek documents was sent at the old address of petitioner, which has resulted in rejection of petitioner's application.

In the facts and circumstances of this case, impugned order is set aside while permitting petitioner to now submit the documents as sought W.P.(C) 11283/2016

by respondent in its Communication of 31st July, 2013 (Annexure P-9). Petitioner's counsel submits that the requisite documents would be furnished to respondent within twelve weeks from today. If it is so done, then petitioner's application for allotment of alternate plot in lieu of acquired land be re-considered by respondent within twenty four weeks and the fate of petitioner's said application be conveyed to him within four weeks thereafter, so that petitioner may avail of the remedies as available in law, if need be.

With aforesaid directions, this petition is disposed of. Dasti.
