This appeal is disposed of with the consent order that the impugned order dated 28.7.2016 closing the evidence of the petitioner/appellant is set aside and petitioner/appellant is now allowed to lead evidence subject to the petitioner/appellant paying costs of Rs.15,000/- to the counsel for the respondent nos.3 and 5. Petitioner/appellant will however ensure that petitioner/appellant will not take more than three opportunities to complete his evidence by way of leading evidence. Counsel for the respondent nos.3 and 5 also states that these respondents will not take

more than three opportunities to complete cross-examination of the witnesses of the petitioner/appellant.

Costs be positively paid within four weeks.

List before the trial court being the court of Dr. Shahabuddin, ADJ-II (N/W), Rohini, Delhi on 22nd May, 2017 and the trial court will take up the matter for further disposal of the case in accordance with law. Trial court record be sent back so that it is available to the trial court on the date fixed being 22.5.2017.
