versus SANGEETA ..... Respondent Through:

Mr. Arpit Bhalla, Adv.

CORAM:

HON'BLE MR. JUSTICE ASHUTOSH KUMAR

O R D E R

% 06.08.2015 The petitioner is aggrieved by the order dated 22.4.2015 passed by the Principal Judge, Family Courts, North District whereby he has been asked to pay a sum of Rs.4,000/- per month to his wife w.e.f. 1.5.2015. The petitioner was married to Smt. Sangeeta sometimes in the year 2013 in accordance with Hindu religious rights. After the marriage, the petitioner and the respondent cohabitated as man and wife for some time. However, later the matrimonial life went through a rough patch. An application came to be filed by the wife for grant of maintenance. The court below directed the petitioner (husband) to file a detailed affidavit of his income, assets and liabilities.

The same was not done.

Let it be noted that the lawyers in the District Courts were abstaining from

work during that period.

Considering the fact that there was no representation of lawyer on behalf of the present petitioner, or his wife, the Principal Judge interacted with both the parties at length. After having talked to them, the court below ordered for the interim maintenance of Rs.4,000/- per month w.e.f.1.5.2015. The wife of the petitioner was asked to furnish her bank account details within a period of three days so that the amount could be deposited in her bank account on or before the 5th day of each calendar month till the time the interim maintenance application is decided. The next date fixed by the court below is 7.7.2015. The strike of the lawyers has been called off. Let the petitioner after making the payments, which has been directed as an ad interim measure, appear before the court below for getting the case decided on merit.

The petition and pending application are disposed of. ASHUTOSH KUMAR, J AUGUST 06, 2015 ns
