Learned Senior Counsel for the petitioner referred to para No.

(17) of the impugned order whereby submissions of A-3 have not been recorded correctly. It has been recorded in para No.(17) that Mr.Sanjay Sehgal, Advocate was representing A-3 Parmod Garg. In fact, A-3 is Devender Kumar and was represented by Mr.M.P.Singh, Advocate. Apparently, there is some lapse while recording A-3's submissions in the impugned order.

The submissions, if any, recorded incorrectly in the impugned order, however, have no serious impact on merits of the case. Crl.M.C. 3815/2016 Page 1 of 2

The Trial Court shall not be prejudiced due to withdrawal of the present petition filed to challenge the legality and propriety of the order on charge.

In view of the above observations, learned Senior Counsel for the petitioner, on instructions, seeks permission to withdraw the present petition with liberty to raise all these issues during trial. 5.

The petition is dismissed as withdrawn with liberty prayed for. Pending application also stands disposed of.
