% 13.09.2017 Learned APP submits that apart from the petitioners, Aysha Khan, Ravi Rai, Manoj Vajpai, Mr. Jitendra Tiwari and Suresh are also accused. On the oral prayer made by the learned counsel for the petitioners, these persons are impleaded as petitioner nos. 3 to 7. Amended memo of parties be filed during course of the day.
It is submitted that petitioners and respondent no.2 have settled their disputes amicably, inasmuch as he does not wish to pursue the FIR against the petitioner nos. 3 to 7; therefore, FIR No.255/2016 under Sections 420/406 IPC registered at police station Paschim Vihar on the complaint of
respondent no. 2, may be quashed. Respondent no. 2 alleged in the FIR that he was looking for a job and petitioners and their accomplices assured to arrange a job for him and took `15,37,600/- from him on different occasions. Accordingly, he filed the present FIR. Respondent no. 2 says that he has settled the matter with the petitioners, who have already paid back `15,37,600/- to him. He has identified his signatures on Compromise Deed dated 15th September, 2015 (Annexure P-4). He further says that he has settled the matter with the petitioners of his own free will and without any undue force, pressure or coercion. Respondent no. 2 further submits that he is not willing to pursue the FIR any further against the petitioners and the same may be quashed in toto.
Keeping in view the settlement arrived at between the petitioners and respondent no. 2 voluntarily, more so, when the terms of settlement have been complied with, in the interest of justice, FIR No.255/2016 under Sections 420/406 IPC registered at police station Paschim Vihar, which is at the investigation stage, is quashed.
