1. The Petitioner has approached this Court for issuance of directions to the Respondents to produce her second daughter aged 16 years. She apparently went missing while the Petitioner was visiting her sister on 26th May 2018 with the said daughter and the elder daughter. On her complaint, FIR No.265/2018 has been registered under Section 363 IPC at PS Jaitpur.

2. On receipt of advance copy of the petition, Inspector Sanjay Sinha, SHO of PS Jaitpur, has filed a status report in which inter alia it is stated that on making enquiries, it was found that the missing girl had gone with one Amit who belongs to Gorakhpur, Uttar Pradesh. On 8th September 2018, a raid was conducted at the house of said Amit at WP (Crl.) 2687/2018

his village in District Gorakhpur and it was found that he and the girl were residing in Gorakhnath Mandir.

3. The Petitioner's missing daughter has since been brought to Delhi and medically examined. Her statement under Section 164 Cr PC was recorded before the learned Metropolitan Magistrate in Delhi. She is present in Court today. Although in her statement under Section 164 Cr PC she appears to have said that she went with Amit of her own free will and wants to stay with him, today in Court she conveyed that she wishes to stay with her mother, i.e. the Petitioner. We then met the girl in the chamber. She reiterates that she wishes to stay with her mother. She, however, says that she went with Amit on her own and does not want any action to be taken against him pursuant to FIR No.265/2018.

4. Since the girl has expressed her desire to return to her mother, she is permitted to do so straightway from the Court itself. If the Petitioner seeks any police protection for herself and her daughter, the SHO will assess the requirement and issue appropriate orders. The petition is disposed of in the above terms.
