% 18.01.2018 Counsel for the appellant seeks permission to withdraw the present appeal after the counsel for the respondents brought to the notice of the Court that the amendment application filed by the first respondent has been allowed by the trial court where the suit filed by the appellant is pending. Counsel for the appellant states that this statement is without prejudice to the rights of the appellants to take appropriate steps. Counsel for the first respondent states that he has no objection in case appeal is withdrawn but would object to any fresh application being filed in the execution proceedings as all issues and contentions have already been settled and decided. He states that the first respondent is contesting the suit filed by the appellant and an application under Order 7 Rule 11 of the Code of Civil Procedure is pending.

We have taken the statements on record without commenting on any

aspect. The appeal is dismissed as withdrawn. SANJIV KHANNA, J.
