% 12.09.2018 Learned counsel for petitioner submits that complainant / injured was examined as PW-4 and in his examination-in-chief, he has not named petitioner as assailant. He was declared hostile and cross examined by the learned APP.

He denied that petitioner had fired at him by a pistol given by co-accused Jitender @ Bhaiya to him. Statement of PW-4 is on record and has been perused. Petitioner is in custody for the last more than 11⁄2 years. Keeping in mind the totality of the facts and circumstances of this case, petitioner is admitted to bail, subject to his furnishing a personal bond in the sum of `20,000/- (Rupees Twenty Thousand Only) with one surety in the like amount to the satisfaction of the trial court.

Bail application is disposed of in the above terms.
