1. Exemption allowed, subject to all just exceptions. Review Petition No. 352/2017
2. At the outset learned counsel for the Petitioner points that Mr. Lal Singh who figures at Sl.No. E has expired. It may be noted that Mr. Lal Singh is shown in the memo of parties in the review petition as a legal heir of Smt. Kartari Devi (deceased) who is the original Petitioner.
3. The Court substitutes Mr. Lal Singh by his legal representatives on the oral request of the counsel for the Review Petitioner.
4. The Court has considered the submissions made by counsel for the Petitioner seeking recall of the order dated 25th July, 2017 whereby WP (C) No.5741/2015 was dismissed. Apart from the fact that the Court finds no grounds to review the said order, the Court additionally finds that in view of the fact that the petition is barred by laches and delay and the lands in question form part of an unauthorised colony awaiting regularisation, the petition has to fail in view of the decision in Mool Chand vs. Union of India 2019 (173) DRJ 595 DB.
5. The review petition is accordingly dismissed. The application is also dismissed.
