The petitioner seeks regular bail under Section 439 Cr.P.C. in case FIR No.41/2015 registered under Sections 363/376/506 IPC and Section 4 POCSO Act at Police Station Uttam Nagar. Status report not filed.

I have heard the learned counsel for the parties and have examined the file. The petitioner is in custody since 20.01.2015. Examination-in-chief of the prosecutrix has been recorded on 12.5.2017. She has not supported the prosecution and has resiled from her previous statement made before the police and statement BAIL APPLN. 1092/2017

recorded under Section 164 Cr.P.C. She is aged around 21 years. She did not level any allegation of rape upon the petitioner. She was cross-examined by the learned APP after court's permission. She denied the suggestions put to her in the cross-examination. 3.

Considering the facts and circumstances of the case, the petitioner is admitted to bail on his furnishing personal bond in the sum of `40,000/-with one surety in the like amount to the satisfaction of the Trial Court.

The bail application and all pending application(s) stand disposed of.
