% 05.11.2015 CM No. 16921/2015 (exemption) The exemption is allowed subject to all just exceptions. FAO(OS) 316/2015 and CM Nos. 11164/2015, 11166/2015, 16146/2015, 16920/2015 The Vakalatnama of respondent No. 2 which is filed by the learned counsel is taken on record.

The mediation has been successful and a Settlement Agreement has been entered into between the parties on 20.10.2015. All the parties are present in court, however, we may state that the partnership concern / respondent No. 1 is today represented through Mr Gulraj Shahpuri who is also a partner in the firm. All the other parties who have signed the Settlement Agreement are also present and they confirm the Settlement Agreement.

The learned counsel for the appellant confirms that the appellant has complied with paragraph 11(ix) of the Settlement Agreement as all cases have been withdrawn.

The learned counsel for the parties also state in the presence of the parties that instead of separate sale deeds to be executed by the appellant and respondent No. 2 as mentioned in paragraph 11(ii) of the Settlement Agreement, a joint sale deed would be executed. All parties undertake that they shall comply with the terms of the Settlement Agreement and this order which is passed today. The undertaking given by the parties is accepted. The award stands modified in terms of the settlement and the directions given today.

The appeal stands disposed of.

The interim orders stand vacated.
