% 05.10.2016 Petitioner is aggrieved by certain alleged illegal construction which had been carried out at property bearing no. 2/33, Nirankari Colony, Delhi.
On advance notice counsel for the respondent / NDMC has put in appearance. His submission is that petitioner has no locus standi to prefer this petition as he is not a resident of the respondent. On this count counsel for the petitioner submits that he has averred in para 3 of the petition that he visits very often to his niece's house residing in the same locality and was injured in road accident as the debris and building material laying in the street at front of said unauthorized construction was the cause of road accident. His complaint to police
has also not been answered.
On advance notice counsel for respondents no. 1 and 2 have appeared. Respondent no.1 submits that this writ petition will be treated as representation of the petitioner to the Department and will be answered in accordance with law. The same be answered within a period of 8 weeks from today.
No further orders are called for.
Petition disposed of.
